Terms of Service

These Terms are between you (the merchant or authorized store staff member) and Noxify (“we”, “us”). They apply to https://noxify.io, related pages, and our Shopify apps (including Presswall). If you use an app on behalf of a business, you represent that you have authority to bind that business.

We provide software tools that integrate with Shopify (for example, Presswall’s “As Seen On” press logo strips via a theme app extension and admin UI). Features may change as we improve the product. We may offer free and paid plans; pricing shown in the Shopify App Store or in-app is controlling for that plan.

You must have a valid Shopify store and comply with Shopify’s terms and policies. Our apps are independent of Shopify Inc. Shopify is not a party to these Terms and is not responsible for our apps. Access to Shopify APIs is subject to Shopify’s rules; if Shopify revokes access or changes APIs, app features may be limited.

• Provide accurate information and keep your Shopify admin secure.
• Use the apps only for lawful purposes and in line with any outlet brand guidelines when displaying third-party logos.
• Ensure you have rights to any custom logos or content you upload.
• Do not reverse engineer, abuse, or attempt to disrupt our services or other merchants’ stores.

We and our licensors own the apps, branding, bundled outlet logo assets (as packaged for app use), and documentation. You retain ownership of content you upload. You grant us a limited license to host and display that content solely to provide the service. Bundled publisher marks remain the property of their respective owners; we provide them for convenience in building press-style strips and do not claim affiliation with those outlets unless stated.

We aim for reliable uptime but do not guarantee uninterrupted service. We may modify, suspend, or discontinue features with reasonable notice when practical. Critical security changes may ship immediately.

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW. We do not warrant that the apps will meet every commercial goal (e.g. conversion lift) or that storefront display will be identical across all themes and devices.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NOXIFY WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THE SERVICES WILL NOT EXCEED THE AMOUNTS YOU PAID US FOR THE APP IN THE TWELVE (12) MONTHS BEFORE THE CLAIM (OR USD $0 IF THE APP IS FREE).

You will defend and indemnify us against claims arising from your misuse of the services, your content (including uploaded logos), or your violation of these Terms or applicable law.

You may stop using the apps and uninstall them at any time. We may suspend or terminate access if you breach these Terms or if continued use would harm the service or others. Sections that by nature should survive (including IP, disclaimers, liability limits, and indemnity) will survive termination.

Our collection and use of information is described in our Privacy Policy, which is incorporated by reference.

These Terms are governed by the laws applicable in the jurisdiction where Noxify primarily operates its business, without regard to conflict-of-law rules, except where mandatory consumer or merchant protections in your location apply. Courts in that jurisdiction will have exclusive venue, except where the law requires otherwise.

We may update these Terms by posting a new version on this page and updating the effective date. Material changes will be highlighted when practical. Continued use after the effective date constitutes acceptance where permitted by law.
